The tax-relief industry loves to make IRS problems sound impossible without them. They're not. I'm Darrin Mish. I've been representing taxpayers before the IRS for 32 years. Let me explain how this actually works.
The U.S. District Court for the District of Columbia granted a Judicial Watch motion and ordered the IRS to report the status of the emails of Lois Lerner that had previously been stated to have been lost. Issues regarding the retrieval of the emails were raised when some of them were recovered from backup tapes. Judicial Watch seeks production of the emails as part of its FOIA lawsuit against the IRS that arose from allegations that it targeted both private citizens and conservative political groups in the months preceding Obama’s re-election.
The Judicial Watch motion sought a response from the IRS as to whether all of the emails retrieved from the backup tape system have been turned over to the IRS, the number of those emails and an anticipated date for production of them by the IRS. At this juncture, 1,268 backup tapes are known to exist. Judicial Watch also seeks an answer as to what emails are recoverable, and if not recoverable, the anticipated date of the completion of processing by the IRS. More than 32,000 of Lerner’s email previously alleged to be lost have been recovered from backup tapes. An additional 324 of such tapes are known to be in existence.
It remains uncontested that the allegedly lost emails that were recovered are from the office of Lois Lerner and cover the time span sought by Judicial Watch. The IRS also clearly reported publicly that the backup tapes had been recycled and were no longer available.
