Unless of course you are owed refunds in those past years. In that case, you will only be able to file your last threes years of unfiled tax returns.<\/p>\n<figure id=\"attachment_17923\" aria-describedby=\"caption-attachment-17923\" style=\"width: 300px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-17923 size-medium\" src=\"https:\/\/getirshelp.com\/blog\/wp-content\/uploads\/2016\/10\/unfiled-taxes-Mish-300x225.jpg\" alt=\"image of Darrin T. When you do you&#8217;ll see a complete list of what I have available for you.<\/figcaption><\/figure>\n<p>The IRS makes a big deal out of unfiled taxes because the tax system is based on voluntary reporting of income.<\/p>\n<p><strong><a href=\"https:\/\/www.irs.gov\/irm\/part4\/irm_04-012-001.html\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Internal Revenue Manual 4.12.1<\/a><\/strong> states that in most cases, the IRS is only going to demand to receive the last six years of unfiled taxes.<\/p>\n<h3>There are some exceptions to this rule.<\/h3>\n<p>One of those exceptions is if\u00a0the IRS has prepared something called a Substitute for Return for you.\u00a0\u00a0Which is a return the IRS prepares under <strong>IRC Code Section <\/strong>6020B. It allows them to\u00a0file substitute returns in place of your\u00a0unfiled taxes.<\/p>\n<p>If you owe over $25k in those Substitute for Returns you chances are they will send a revenue officer to speak with you.<\/p>\n<p>If hit with this, you have the right to a process called Audit Reconsideration. Which would allow\u00a0you to\u00a0file the original return(s)?\u00a0\u00a0In most cases, this will reduce your tax penalties and interests.<\/p>\n<p>For example, let&#8217;s say you have a 2009 <a href=\"https:\/\/www.irs.gov\/irm\/part4\/irm_04-012-001.html\" target=\"_blank\" rel=\"noopener\"><strong>SFR return<\/strong><\/a> and it&#8217;s now 2016.
