I hear from people every week who think their tax problem is the end of the world. It usually isn't. I'm Darrin Mish. I've resolved over $100 million in tax debt for clients. Here's what you should know.<\/p>\n

Nearly 600 non-profit organizations in Ventura County have received notices from the IRS that their tax-exempt status has to be revoked due to non-filing of tax returns for the last 3 consecutive years. \u00a0In California as a whole, the number is about 40,000. \u00a0Even though these organizations do not have to pay taxes, they are still obligated to submit information returns or notices. \u00a0This is in accordance with the Pension Act 2006 passed by Congress.<\/p>\n

Last month, The IRS announced that more than 275,000 groups nationwide have lost their tax-exempt status<\/a> for failing to file their tax returns within the time limit of 3 years. \u00a0This action has been part of the IRS\u2019 efforts to weed out disbanded or defunct non-profit organizations from their list. \u00a0Nevertheless, the action has affected legitimately active non-profits, like the Hungry Soul Ministry in Camarillo in Ventura County.<\/p>\n

The Hungry Soul Ministry was still an active organization with volunteers sharing the Gospel through works of charity. \u00a0They still did gardening chores for senior citizens, paid home visits to the sick and the elderly and helped out at area food banks. \u00a0Their problem was their new set of directors who pretty much ignored the IRS notice to file their tax returns.<\/p>\n

In light of this, the IRS has given their assurance that they are actively seeking to help active non-profit organizations affected by the de-listing. \u00a0IRS Commissioner Doug Shulman commented, \u201cDuring the past several years, the IRS has gone the extra mile to help make tax-exempt groups aware of their legal filing requirement and allow them additional time to file. \u00a0Still, we realize there may be some legitimate organizations, especially very small ones, that were unaware of their new filing requirement.\u201d<\/p>\n

For smaller organizations, the law imposing a filing requirement came into effect in 2007. \u00a0The law automatically cancels the tax-exempt status of any non-profit organization that fails to submit information returns for 3 consecutive years. \u00a0This means that these organizations no longer are allowed to receive tax-deductible donations and all their income becomes taxable.<\/p>\n

Besides Hungry Soul Ministry, other non-profit organizations in Ventura County affected include a whole range of organizations like arts clubs, cultural organizations, charities for the homeless, professional associations, historical societies, youth sports leagues, environmental activist groups and civic organizations such as the Knights of Columbus. \u00a0Although most of these no longer exist, there are some that are still active.<\/p>\n

Many of the affected organizations have had to take up legal advice from attorneys or public accountants on this matter to try to have their tax-exempt statuses reinstated.<\/p>\n
