You can pay some but not all debts with a payment plan through Chapter 11, 12, or 13 bankruptcy.<\/p>\n<p>To qualify for a Chapter 7 bankruptcy, you have to meet these 5 criteria:<\/p>\n<p>Tax return filing due date is at least 3 years old prior to filing for bankruptcy<\/p>\n<p>Tax return was filed a minimum of 2 years prior to filing for bankruptcy<\/p>\n<p>Tax assessment is at least 240 days before filing for bankruptcy<\/p>\n<p>Tax return was not fraudulent<\/p>\n<p>Taxpayer was not guilty of tax evasion<\/p>\n<p>It&#8217;s also important to take note that not all tax debts are eligible to be discharged. <a href=\"https:\/\/getirshelp.com\/blog\/tag\/unfiled-tax-returns\/\">Obviously, unfiled tax returns can&#8217;t be discharged.<\/a> Before your case can be heard before the creditors&#8217; meeting, you should have filed your tax returns from the past 4 years. Provide a copy of your most recent tax return to the bankruptcy court and to your creditors.<\/p>\n<p>You have to be prepared for the long term repercussions of bankruptcy on you and your family.
